Deadline

Lodge within 28 days of accident for backdated benefits; absolute limit is 6 months. Common law damages: 3 years.

How to apply

  1. Report the accident to police if injuries occurred and obtain the police event number.
  2. Identify the at-fault vehicle's registration number and use SIRA's online insurer-finder tool at sira.nsw.gov.au to identify the correct CTP insurer.
  3. Download the 'Application for Personal Injury Benefits' form from sira.nsw.gov.au or collect it via Service NSW, or lodge entirely online through your MyServiceNSW Account (add 'Motor accident injury claims (CTP insurance)' under My Services).
  4. Complete the form with accident details, injury description, treating doctor details, and employment information.
  5. Attach supporting documents: medical certificate from your treating doctor, proof of identity, and any other evidence of injury or income loss.
  6. Lodge the completed form with the CTP insurer within 28 days of the accident to ensure backdated benefits are payable from the accident date; the maximum lodgement window is 6 months.
  7. The insurer must acknowledge your claim within 10 business days and make an initial liability decision within 4 months.
  8. If the insurer disputes liability or you are not at fault, contact CTP Assist on 1300 656 919 for guidance.
  9. For common law damages claims (serious injuries), a separate Application for Damages Under Common Law form must be lodged within 3 years of the accident.
