How to apply

  1. Download the current version of the Fair Work Information Statement (FWIS) from the Fair Work Ombudsman website — updated annually around 1 July each year (last updated August 2025).
  2. Confirm you are using the most up-to-date version before giving it to a new employee, as an outdated version may still constitute a breach.
  3. Provide the FWIS to the new employee before they start, or as soon as practicable after they commence employment.
  4. Deliver the statement in an accessible format: in person, by email, by email link to the FWO website, by mail, or by fax.
  5. For casual employees, also provide the Casual Employment Information Statement (CEIS) at the same time.
  6. For employees on fixed-term contracts, also provide the Fixed Term Contract Information Statement (FTCIS).
  7. Retain a record of when and how the statement was provided to each employee in case of a Fair Work investigation.
  8. Note: failure to provide the FWIS is a breach of the National Employment Standards and can attract financial penalties.
