How to apply
- Confirm eligibility: you must be an 'employee-like worker' on a digital labour platform, earning under $175,000/year, have worked regularly for at least 6 months after 26 August 2024, and have been deactivated on or after 26 February 2025.
- Check the 21-day deadline: Form F89 must be lodged within 21 days of the date you were deactivated — act promptly as extensions are rarely granted.
- Download or access Form F89 ('Apply for unfair deactivation — for regulated workers') from the Fair Work Commission website.
- Complete Form F89 with your personal details, the digital platform's details, the date and circumstances of deactivation, and the reasons you believe the deactivation was unfair.
- Pay the application fee of $89.70 (2025–26 rate) when submitting — fee waivers may be available in cases of financial hardship.
- Lodge Form F89 via the Fair Work Commission's online lodgement portal, by email, or in person at an FWC office.
- The platform (respondent) must then file Form F89A in response within the timeframe set by the Commission.
- Attend any conciliation conference arranged by the FWC — most matters are resolved at this stage without a formal hearing.
- If not resolved at conciliation, the matter proceeds to arbitration where the FWC can order reactivation or compensation for lost earnings.
