Pool and spa owners must register their pool on the relevant state register and obtain a compliance certificate from a licensed inspector, which is required before selling or leasing a property with a pool.

How to apply
- Register the pool or spa on the relevant state register: NSW — swimmingpoolregister.nsw.gov.au; VIC — contact your local council; QLD — my.qbcc.qld.gov.au/myQBCC/s/pool-register (registration is free in all states)
- Engage a licensed pool inspector: NSW — a council inspector or NSW Fair Trading-registered private certifier; VIC — a registered building surveyor or building inspector; QLD — a QBCC-licensed pool safety inspector
- The inspector assesses the pool barrier against the applicable safety standard (determined by the pool's construction date)
- If the barrier is non-compliant, rectify all defects identified in the non-conformity notice before re-inspection
- Once compliant, the inspector issues the compliance certificate: QLD Form 23 (lodged with QBCC by the inspector); VIC Form 23 (Certificate of Pool and Spa Barrier Compliance, lodged with council within 30 days); NSW Certificate of Compliance (issued within 3 days of inspection)
- Lodge the certificate with your local council (VIC, cost approx. $22.50; NSW councils charge up to $150 for first inspection)
- Provide the compliance certificate to the buyer or real estate agent prior to settlement or at commencement of a new tenancy
- Renew: QLD every 2 years; VIC every 4 years; NSW as required at sale/lease
