Operators of a general boarding house (5 or more paying residents) or assisted boarding house (2 or more residents with additional needs) in NSW must register with NSW Fair Trading within 28 days of commencing operation and renew the registration to remain on the public register.

How to apply
- Determine whether your premises qualify: a general boarding house accommodates 5 or more paying residents (excluding proprietor, manager, and their families); an assisted boarding house accommodates 2 or more people with additional support needs
- Consult your local council to check whether development consent is required before operating the boarding house
- Download and complete the 'Notification to register a boarding house on the Register of Boarding Houses' form from NSW Fair Trading or Service NSW
- Pay the $100 registration fee — by credit card/EFTPOS at a Service NSW / Fair Trading Centre, online as instructed on the form, or by cheque/money order (payable to NSW Fair Trading) if posting
- Lodge the completed form and payment within 28 days of the premises becoming a registrable boarding house, or within 28 days of becoming a new proprietor — submit in person at a Service NSW / Fair Trading Centre, by email, or by post to: Boarding House Register, NSW Fair Trading, PO Box 972, Parramatta NSW 2124
- Your boarding house will be listed on the public NSW Fair Trading Accommodation Register (name, address, proprietor names, classification, and local council area are publicly visible)
- Provide written occupancy agreements to all residents as required under the Boarding Houses Act 2012
- Allow the local council to conduct a mandatory inspection within 12 months of registration; comply with occupancy principles under the Act on an ongoing basis
