How to apply
- Identify the correct body: in Victoria use VEOHRC (humanrights.vic.gov.au); for federal racial hatred under RDA s18C use the Australian Human Rights Commission (humanrights.gov.au/complaints); in QLD use the Anti-Discrimination Commission Queensland.
- Note that from 15 April 2026 in Victoria, vilification complaints are governed by the amended Equal Opportunity Act 2010 (the RRTA is repealed); for conduct before that date the RRTA still applies.
- Gather details: your contact information, the respondent's details, a clear description of what was said or done, when and where it occurred, and any evidence (screenshots, witnesses).
- Lodge via VEOHRC's online complaint portal at makeacomplaint.humanrights.vic.gov.au, or call 1300 292 153 (weekdays 10am–2pm), or email complaints@veohrc.vic.gov.au.
- For federal complaints (AHRC), complete the online complaint form at humanrights.gov.au/complaints.
- The Commission assesses your complaint; they will contact you if additional information is required.
- If accepted, the Commission contacts the respondent and the conciliation process begins — a conciliator helps both parties explore resolution options.
- If conciliation fails in Victoria, the matter may be referred to VCAT for a formal hearing.
- Ensure you lodge within any applicable time limit — VEOHRC advises contacting them promptly; AHRC has a 12-month limit from the date of the act.
