How to apply

  1. Confirm you hold a valid, unsatisfied civil judgment from the Magistrates' Court of Victoria.
  2. Register any interstate judgment with the Magistrates' Court before proceeding if the judgment was obtained in another jurisdiction.
  3. Download and complete Form 68A — Warrant to Seize Property (available as PDF or Word from mcv.vic.gov.au).
  4. File the original and a copy with the Magistrates' Court registry where the judgment was made, via the CMS Portal or in person.
  5. Pay the required lodgement fee at filing (fees apply from 30 June 2025 and are recoverable from the debtor).
  6. Once the warrant is issued (valid for 12 months), send it to the Sheriff's Office — the court does not do this automatically.
  7. Pay the Sheriff's enforcement fee; the Sheriff will attend the debtor's premises to demand payment or seize personal property.
  8. If the debtor does not pay, the Sheriff will seize and sell eligible property at public auction, with proceeds applied to the debt.
