How to apply

  1. Receive written notice of the planning or development decision you wish to challenge (e.g. refusal of a development application by a local council, the WAPC, MRA, or a DAP).
  2. Confirm the 28-day lodgement deadline from the date the original decision-maker gave notice of its decision — SAT can grant extensions but you must request one in your application.
  3. Determine whether your application will be Class 1 (development value under $250,000, or under $500,000 for a single dwelling/subdivision of up to 3 lots) or Class 2 (all others), as this affects fees and procedure.
  4. Create an account or log in to the SAT eCourts Portal at ecourts.justice.wa.gov.au and commence a new planning review application.
  5. Upload required documents: completed application details, a copy of the decision under review, and copies of original development plans at the correct scale.
  6. Pay the applicable filing fee (Class 1 attracts lower fees than Class 2 — consult the SAT fees schedule at sat.justice.wa.gov.au).
  7. Serve a copy of your application on the original decision-maker within 7 days of lodging with SAT.
  8. Attend the initial directions hearing listed by SAT, at which the Tribunal will set the timetable for mediation or a formal hearing.
  9. Participate in any mediation or hearing as directed, and file any expert or factual evidence in the timeframes set by the Tribunal.
