How to apply
- Confirm you are an eligible appellant — either the applicant who received a decision, or a submitter who lodged a 'properly made' submission about the development.
- Note the decision date; you have 20 business days from the date the decision is given to file your Notice of Appeal.
- Download Form PEC-1 — Notice of Appeal from the Queensland Courts Planning and Environment Court forms page (courts.qld.gov.au).
- Complete the form: identify the decision being challenged, state the orders or relief sought, and set out numbered grounds explaining why the decision is alleged to be wrong.
- File the completed Form PEC-1 at the Planning and Environment Court registry in Brisbane (or submit as directed by the registry) and pay the applicable filing fee.
- Send a copy of the Notice of Appeal to the Chief Executive of the responsible state planning department by email to pecappeals@dsdip.qld.gov.au as required under the Planning Act 2016.
- Serve a copy of the Notice of Appeal on all respondents (including the relevant local government / decision-maker).
- Respondents have 10 business days to file a Form PEC-5 — Entry of Appearance if they intend to participate.
- Attend the first return date set by the court; consider whether mediation is appropriate to resolve the dispute before a full hearing.
