How to apply

  1. Check eligibility: you must be a current employee (or prospective employee, independent contractor, or other protected person) who has experienced adverse action not involving dismissal — e.g. demotion, pay cut, changed duties, threats, or coercion.
  2. Note the time limit: unlike the dismissal stream, you have up to 6 years from the date of the adverse action to lodge Form F8C.
  3. Access the form at the Fair Work Commission website — available as an online lodgement or as a downloadable PDF (Form F8C).
  4. Complete Form F8C providing details of the adverse action, the general protection you believe was breached, and the outcome you are seeking.
  5. Pay the lodgement fee of $89.70 (2025–26 rate; changes on 1 July each year) when submitting online, or apply for a fee waiver using Form F80 if payment would cause serious financial hardship.
  6. Lodge the completed form via the FWC Online Lodgement Service, by email, post, or in person at a Fair Work Commission registry.
  7. The Commission will notify the respondent (usually the employer), who must file a response using Form F8D.
  8. Attend a conciliation conference arranged by the Commission; if not resolved, the matter may proceed to arbitration or court.
  9. Note: if your employer dismisses you after you lodge Form F8C and you believe the dismissal is retaliation, contact the Commission immediately as a separate application may be required.
