How to apply

  1. Confirm you are 18 or older and currently have decision-making capacity.
  2. Decide who you will appoint as your financial attorney — State Trustees Limited can act as attorney for a fee if no suitable person is available.
  3. Download the Enduring Power of Attorney (Financial) fillable PDF form from the Department of Justice and Community Safety at justice.vic.gov.au/powers-of-attorney-act-2014.
  4. Consider obtaining legal advice before completing the form; contact the Office of the Public Advocate on 1300 309 337 (Mon–Fri 9am–3pm) for guidance, or engage a private solicitor.
  5. Complete the form, specifying any limitations or conditions on your attorney's financial powers.
  6. Execute the document in the presence of two adult witnesses — one witness must be authorised to witness affidavits or be a registered medical practitioner.
  7. Ensure the following people are NOT witnesses: your attorney or their relatives, your relatives, your care worker, or your accommodation provider.
  8. Give a copy to your attorney, your GP, and keep the original in a safe place — the document takes effect when you lose capacity unless you specify otherwise.
