Step-Parent / Relative Adoption Application
Each state and territory has its own application form and process for a step-parent or relative to legally adopt a child they are raising, requiring an assessment, consent from the non-custodial parent, and a final court order.

How to apply
- Contact your state or territory adoption services agency to confirm eligibility (step-parent must generally be an adult Australian citizen or permanent resident living with the child for at least 3 years)
- Download and complete the state-specific application form (e.g. WA: 'Step-parent adoption form' from wa.gov.au; QLD: 'Application to adopt a step-child' PDF from qld.gov.au; NSW: contact DCJ Adoption at adoption.permanentcare@dcj.nsw.gov.au)
- Gather certified identity documents for the applicant, child, and both biological parents
- Obtain consent from the non-custodial birth parent, or prepare to apply to court for a dispensation of consent
- Lodge the completed application and supporting documents with your state adoption services office and pay the assessment fee
- Undergo the formal assessment process including background checks, home visits, and interviews conducted by adoption services
- Adoption services prepares a suitability report for the relevant court (e.g. Children's Court in QLD, Supreme Court or County Court in other states)
- Attend the court hearing where the judge makes the final adoption order
- Once the order is granted, register the adoption with your state Births, Deaths and Marriages registry and obtain the new birth certificate
