An electronic dealing lodged on a property title by a buyer (or their conveyancer) between exchange of contracts and settlement to record their priority interest and prevent unauthorised dealings from being registered ahead of their Transfer.

NSW: ~$40.31 to lodge, $16.70 to extend or withdraw. QLD and VIC: similar nominal fees via ELN. Significantly cheaper than lodging a caveat (~$1,400).
Deadline
Must be lodged before settlement; effective for 60 days (extendable once by 30 days). Not available in WA or SA — those jurisdictions use caveats for equivalent protection.
How to apply
- Buyer's conveyancer or solicitor logs into PEXA (or Sympli) and creates a Priority Notice workspace for the relevant title.
- The intended dealings to be protected (e.g. Transfer, Mortgage) are listed in priority order on the notice.
- The Priority Notice instrument is digitally signed by the subscriber lodging it on behalf of the buyer.
- The notice is lodged electronically with the relevant state Land Registry — it appears immediately on title searches.
- The Priority Notice is effective for 60 days from lodgement and prevents registration of any dealing not listed on it.
- If settlement is delayed beyond 60 days, an Extension of Priority Notice (one extension only, adding 30 days) is lodged before expiry.
- At settlement, the Transfer and any new Mortgage are lodged simultaneously through the same PEXA workspace, automatically displacing the Priority Notice on registration.
